1. Acceptance of general conditions
The use of the services of ResidenceRental automatically implies the acceptance of the general conditions, as well from the part of the advertiser / owner as of the tenant.
2. Description of the services
ResidenceRental only offers the transfer of information and the possibility to provide contact between owner and tenant through her site. ResidenceRental cannot be held responsible for the availability, the cancellation or the implementation of the communication or the personal settings of the users.
3. Advertising
At the registration with ResidenceRental, the advertiser will give his correct personal information as requested in the questionnaire. The advertiser binds himself to give the complete, correct and present situation about the properties presented by him.
4. Loginname - Password
After the registration the advertiser can make his own login name and password. He is solely responsible for the privacy of these details. ResidenceRental will not be held responsible for illegal access and use of the site of advertiser.
5. Privacy
- ResidenceRental will not provide any personal information to third parties.
- ResidenceRental will not provide any information about the proposed properties to third parties without the permission of the owner.
- ResidenceRental will not participate in the distribution of unauthorized commercial e-mail messages and will not tolerate this.
6. Responsibility
- The advertiser is solely responsible for the information, data, text, messages and any other oral or written communication (called content hereafter) that he proposes on his site or on any other medium.
- ResidenceRental is not responsible for the content of the site and does not take any responsibility nor gives any guarantee about the correctness of the given information.
- ResidenceRental is not responsible for typographical errors in the given information.
- The prices and conditions proposed by the advertiser can be changed without notice and must always be confirmed at the reservation.
7. Links
ResidenceRental, her partners can include links to other sites or services. As residenceRental is not in the ability to check these sites or information, ResidenceRental can never be held responsible for the content, advertisements, offers, services and any other material connected to these sites or links.
8. Relation between tenant and advertiser / owner
All communication between the advertiser and the (potential) tenant, takes place without any interference from ResidenceRental. This includes oral and written information, availability, prices, confirmation, address, itinerary, etc. ResidenceRental thus cannot be held responsible for any damage or costs resulting from the relation between the tenant and the advertiser or anything related to this, including theft, damage or loss of equipment. Tenant and owner should make sure they have adequate insurance.
9. Complaints
Remarks and complaints concerning the rented property must be addressed solely to the advertiser of the property (owner or agent). ResidenceRental will not accept any responsibility about the availability, the state or the price of the offered property. If ResidenceRental is informed about faults of the property, ResidenceRental is entitled to exclude the advertiser.
10. Transformation, temporary stop or cancellation of services
If ResidenceRental is not able to guarantee the services or the quality of it for any reason, including but not limited to defects, war, acts of God, nor ResidenceRental nor the advertisers will be held responsible for the costs suffered above the already made expenses.
11. Right concerning the content
ResidenceRental has the right to refuse any advertisement that does not respect the demands of decency or legal regulations. The text of the advertisement can be adapted to the standard layout, without changing the content of it. This information cannot be copied without the written consent of ResidenceRental.
12. Cancellation of the advertisement
The advertisement at residenceRental is made for the duration of one year (except if agreed otherwise in writing). Due to the fact that during the first weeks of the contract period a great deal of work and activity are necessary for the promotion of the property on the Internet, the creation and translation of texts for the site, the insertion of the pictures and access to the search engines etc. it is not possible for ResidenceRental, in case of cancellation by the advertiser, to reimburse any amount.
13. Exclusion of advertiser
ResidenceRental has the right to exclude an advertiser (without reimbursement) if he does not fit in the required conditions has given incorrect information about himself or the property or in any other way does not live up to the quality and the expectations uses the name ResidenceRental or any of the related websites to send SPAM e-mails.
14. Withdrawal of property
If the advertisement page for a property is withdrawn, ResidenceRental can put the advertisement on hold until later. The advertisement stays valid for the original period. Eventually the advertiser can propose another house in place of the original one. This transfer will be charged, as a completely new advertisement has then to be made.
15. Sale of the advertised property
If the advertised property is sold, the advertisement can be transferred to the new owner. This transfer is charged (US$ 20). No reimbursement is possible, but the owners can come to an arrangement between themselves.
16. Rights
The names and domains ResidenceRental, and the dutch version HolidayRental.nl and other domains and services of ResidenceRental are the property of EHOLD BV. Without written express authorization of EHOLD BV third parties can use any of these names or domains.
ResidenceRental is an activity of EHOLD BV and IT Vision Inc.
